Painterner Intelligence Terms of Service

1. Scope of Services

Painterner Intelligence ("we") is a portal that unifies AI generation, applied research, and intelligent deployment. These terms apply to every page inside the portal, our alpha/beta products, APIs, Discord community, and all consulting or delivery services we provide.

2. Definitions

• Alpha/Private Preview: capabilities still in validation.
• Customer: any individual or organization consuming services via the portal or under contract.
• Deliverables: consulting output, tuned models, code, documentation, or other artifacts produced by us.

3. Accounts & Access

Some alpha consoles require dedicated tokens or SSO. Customers must protect credentials and may not resell or share them. We reserve the right to adjust or revoke access whenever security demands it.

4. Acceptable Use

• No illegal, infringing, hateful, fraudulent, or malicious use.
• No attempts to bypass safeguards, reverse engineer, or run unapproved load tests.
• Do not train competing services with our outputs unless a contract explicitly allows it.
• Comply with all applicable laws and industry regulations.

5. Subscriptions & Fees

Alpha capabilities showcased in the portal may be free or subscription-based. Commercial engagements are governed by a mutually signed SOW/MSA that covers platform usage, inference costs, engineering, and support. Late or missing payments can result in suspension.

6. Beta Features & Experiments

Alpha/Beta features are provided “as is” and may change or sunset at any time. We do not guarantee availability, performance, or compatibility, and we may collect anonymized telemetry to improve the experience.

7. Data & Privacy

We only collect business contact details, audit logs, and sample data when needed for tuning. Unless a contract states otherwise, customers keep ownership of their data and outputs. All processing follows our Privacy Policy and any governing agreements.

8. Intellectual Property

The portal, design system, code, imagery, and brand belong to Painterner. Materials and business data provided by customers remain theirs. Unless explicitly licensed, you may not copy or resell our platform, templates, or evaluation methods.

9. Feedback & Co-building

Suggestions, reviews, and fixes you voluntarily provide can be used to improve our services without additional compensation. If co-creation outputs are covered by a separate agreement, that agreement prevails.

10. Service Availability

We schedule maintenance, throttling, and security reviews as needed. Force majeure, infrastructure failures, or vendor limits may cause temporary outages. Free or trial services do not include SLAs; paid engagements follow the SLA spelled out in contract.

11. Disclaimers & Liability

• Services are offered “as is” without express or implied warranties of merchantability, fitness, or noninfringement.
• We are not liable for indirect, incidental, or punitive damages arising from use or inability to use the services.
• Where allowed by law, total liability is capped at the fees paid for the impacted service in the preceding 12 months.

12. Termination

We may suspend or terminate access if these terms are breached or security is at risk. Customers can request termination via email; fees already incurred are non-refundable. Confidentiality and IP obligations survive termination.

13. Updates

We may update these terms as products evolve or laws change. Major updates will be announced via the portal, email, or Discord. Continued use constitutes acceptance of the updated terms.

14. Governing Law

Unless the parties agree otherwise in writing, these terms are governed by the laws of the People’s Republic of China. Disputes should first attempt friendly resolution; failing that, either party may bring action to a competent court in Hangzhou.
